These Terms & Conditions (“Terms”) form a legally binding agreement between you (“Member”) and Gymre, Inc. (“Gymre,” “we,” “our,” or “us”) and apply to your access to and use of gymre.com, our mobile or web applications, and any products, facilities, or services we provide (collectively, the “Services”). By creating an account, purchasing a membership, booking a class, visiting our facilities, or otherwise engaging with the Services, you confirm that you have read, understood, and agree to be bound by these Terms as well as our Privacy Policy. If you do not agree, you must refrain from using the Services.
To be eligible for a Gymre account and membership you must be at least eighteen (18) years of age, or the legal age of majority where you live. Minors aged thirteen (13) to seventeen (17) may participate only with verifiable parental consent and, unless a signed waiver expressly states otherwise, must be accompanied by an adult while on the premises. You agree to provide accurate, current, and complete registration information, to protect your login credentials, and to notify us immediately if you suspect unauthorized access to your account. You are responsible for all activity that occurs under your credentials.
Membership options, prices, and benefits vary by location and are detailed on our website and at the front desk. By purchasing a plan you authorize Gymre and its payment processors to charge the applicable fees, taxes, and other amounts to your chosen payment method on the schedule specified at checkout—typically monthly or yearly. Unless explicitly stated otherwise, memberships renew automatically at the then‑current rate until you cancel. You may cancel at any time through your online account or by contacting Member Services, but fees already paid are non‑refundable except where the law requires otherwise. Late or declined payments may lead to suspension or termination of access, and you remain liable for any outstanding balance.
Some memberships include or require class reservations. You can book classes via our app, website, or front desk, and you must cancel within the timeframe listed in your membership terms—usually four to twelve hours before the class starts—if you cannot attend. Failure to cancel or repeated no‑shows may result in fees, loss of booking privileges, or deduction of class credits, depending on your plan.
While using Gymre facilities you must follow all posted rules, safety instructions, and staff directions. This includes wearing appropriate attire, wiping down and returning equipment, and avoiding conduct that endangers yourself or others. We reserve the right to deny entry, suspend, or terminate memberships for behavior we deem unsafe, disruptive, or in violation of these Terms or any facility guidelines.
Physical exercise carries inherent risks of injury, illness, or death. By engaging in any activity at Gymre, you voluntarily assume all such risks and agree that Gymre is not liable for injuries or medical conditions you may sustain. We strongly recommend consulting a physician before beginning any exercise program and notifying staff immediately of pain, dizziness, or unusual discomfort.
Independent personal trainers or wellness professionals who operate within Gymre may be contractors rather than employees. Payment for their services is solely between you and the provider unless expressly processed through Gymre’s billing system, and Gymre is not responsible for their acts or omissions. All content on our Site and within the Services—including text, graphics, logos, photos, videos, software, and trademarks—is owned by or licensed to Gymre and protected by intellectual‑property laws. You may use this content only for personal, non‑commercial purposes while in good standing, and you may not reproduce, distribute, modify, or publicly display it without our prior written consent.
You agree not to use the Services for any unlawful purpose; harass, abuse, or harm others; upload viruses or malicious code; reverse‑engineer or exploit any portion of the Services; conduct unauthorized advertising or solicitation; or attempt to gain unauthorized access to Gymre’s systems or user accounts. The Services may contain links to external websites or resources that are not controlled by Gymre; we do not endorse and are not responsible for any content, products, or services available through such third parties, and your interactions with them are governed by their own terms and policies.
Gymre may suspend or terminate your account, membership, or access to the Services at any time and without notice if you breach these Terms, pose a safety risk, or engage in fraudulent or abusive behavior. Upon termination, your right to use the Services ceases immediately, but your obligations under the sections on Health Disclaimer, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law will survive.
The Services are provided “as is” and “as available,” without express or implied warranties of any kind, including merchantability, fitness for a particular purpose, or non‑infringement. To the maximum extent permitted by law, Gymre and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages—including lost profits, data, or goodwill—arising out of or relating to your use of the Services. If liability is imposed, our aggregate liability will not exceed the greater of (a) the total fees you paid to Gymre in the twelve months preceding the claim, or (b) one hundred U.S. dollars (US $100). You agree to defend, indemnify, and hold harmless Gymre and its affiliates from and against any claims, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any rights of another person or entity.
These Terms are governed by the laws of the State of California, excluding its conflict‑of‑law principles. Any dispute shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to their personal jurisdiction. Consumer protection laws of your home country may also apply if you reside outside the United States.
We may update these Terms periodically to reflect changes in our business, the Services, or applicable law, posting the revised version with a new “Last updated” date and providing notice of material changes by email or prominent notice on the Site. Continued use of the Services after an update constitutes acceptance of the revised Terms. These Terms, together with any membership agreement, signed waivers, and our Privacy Policy, represent the entire agreement between you and Gymre and supersede any prior understandings. If a provision is deemed unenforceable, the remaining provisions remain in effect.
